We reserve the right to change and adapt this Privacy Policy at any time in compliance with the statutory provisions.

2. Data collection
a) If you only visit our website
When you visit our website, our web servers temporarily save the connection data of the inquiring computer (IP address), time of the server inquiry, the pages you visit on our website, the date and duration of the visit, the identification data of the browser and operating system type used as well as the website from which you visit us (referrer). It is not possible for us to draw conclusions about a natural person from this data.
Our interest in processing of the aforementioned user data consists in particular in ensuring the functionality and security of our information technology systems and in optimizing our web content.
The processing is necessary to protect our aforementioned legitimate interests. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR.
b) If you use our contact form or our service hotline
If you use our contact form or our service hotline, we will process your name together with the form of address, the name of the company you work for, the country in which the company is based, your e-mail address and all other information you provide us with in this regard to process your request. In addition, your IP address is processed and your data is compared with our database in order to determine a possible association with previous requests and thereby provide better feedback.
The processing is based on our legitimate interest, Art. 6 para. 1 lit. f) GDPR, which consists of the facilitated and direct contact option as well as the best possible response to your request and, if applicable, to carry out pre-contractual measures, Art. 6 para. 1 lit. b) GDPR.
c) If you subscribe to our personalized newsletter
You have the option to register for our personalized newsletter on our website to obtain relevant information from us and our group companies (section 7).
If you subscribe to our e-mail newsletter, we store your IP address and the time of registration and confirmation. The legal basis for this is Art. 6 para. 1 s. 1 lit. f GDPR (legitimate interests). Our legitimate interest consists in being able to prove your registration and, if necessary, to investigate any possible misuse of your personal data.
In addition, when you register, we process your name, the name of the company you work for, your e-mail address and, if applicable, details of your title and areas of interest in order to adapt the information in the newsletter to your personal needs. The newsletter contains information about our company, analytical systems, services and after-sales services, invitations to events or trade fairs as well as technical information based on your details and customized to your interests. The legal basis for sending such information is your consent. In order to send you the information, we will use your e-mail address and, if applicable, other details that you provide when registering or that we already have. The processing of these personal data serves also our legitimate interest in direct marketing. The legal basis for this is Art. 6 para. 1 s. 1 lit. f GDPR.
In addition, we evaluate your user behavior within the sent newsletters by combining receipt and reading confirmations as well as information about the links you have clicked on for statistical purposes. We analyze the interests that you indicate when registering for the newsletter and your personal data as well as your reading behavior with regard to the newsletter and - if you are a customer - merge these with your data in the customer database.
This processing of your personal data is based on your consent. The legal basis for this is Art. 6 para. 1 s. 1 lit. a GDPR.
The provision of your personal data is necessary in order to provide you with information tailored to your needs. If you do not provide your personal data or do not give the required consent, we will not be able to provide you with the respective individualized information.
Data transfer to our group companies is based on your consent in accordance with Section 7.
You may withdraw your consent at any time with effect for the future without incurring any costs other than the transmission costs according to the basic rates. The processing of your data until withdrawing remains lawful. You can withdraw your consent by clicking on the link provided in every newsletter e-mail, by sending an e-mail to datenschutz@elementar.com or by sending a message to the contact details given in the imprint.
Insofar as the receipt of our newsletter is not based on your consent, but is legitimized by another legal basis for the purpose of direct advertising, you can object to the processing of personal data concerning you for the purpose of such advertising at any time, Art. 21 para. 2 GDPR. Your personal data will then no longer be processed for this purpose. You can declare your objection by sending an email to datenschutz@elementar.com or by sending a message to the contact details provided in the legal notice.
d) If you request a download of our files
When you request a download of our files, you simultaneously consent to receive our newsletter tailored to your interests (see section 2c). You can revoke your consent at any time with effect for the future without incurring any costs other than the transmission costs according to the basic rates. The processing of your data that was carried out until the revocation remains lawful. You can declare the revocation by clicking on the link provided in each newsletter, by e-mail to datenschutz@elementar.com or by sending a message to the contact details provided in the imprint.
The following data are processed for the supply of the files:
- Salutation
- First and last name
- E-mail address
- Company
- Country
- IP address
This processing of your personal data is based on your consent, which you give by clicking the corresponding button. The legal basis for this is Art. 6 para. 1 p. 1 lit. a GDPR.
If you request a download of our files, we store your IP address and the time of registration and confirmation. The legal basis for this is Art. 6 para. 1 s. 1 lit. f GDPR. Our legitimate interest consists in being able to prove your download and, if necessary, to investigate any possible misuse of your personal data.
The files offered for download contain technical information about our services and products. We analyze the personal data you provide to us when requesting the download and - if you are a customer - merge these with your data in the customer database. The legal basis for this is Art. 6 para. 1 s. 1 lit. f GDPR. It is our legitimate interest to learn about the main interests of our users and customers in order to align and optimize our marketing.
e) Attending a webinar
We offer various webinars about our products and services. To register and participate in the webinars, you will need to provide us with the following data:
- Title
- First and last name
- E-mail address
- Country
- Company/organization
We need this data in order to provide you with the login details for the webinars and to identify you. We process this data on the basis of Art. 6 (1) Sentence 1 lt. b GDPR to fulfill our contractual obligation to offer you webinars. We will also use your e-mail address after the webinar to send you materials about the webinar you attended.
By registering for the webinar, you agree to receive advertising materials. The associated data processing takes place on the basis of Art. 6 (1) lt. a GDPR. We will use your e-mail address as well as your first and last name to send you advertising materials. This will exclusively include further details about your chosen webinar, information about upcoming webinars and similar events, products and applications. You can revoke your consent at any time with effect for the future using the link provided at the bottom of each e-mail, without incurring any costs other than the transmission costs according to the basic rates.
For the webinar, we use the services of GoTo Technologies Ireland Unlimited Company, The Reflector 10 Hanover Quay, Dublin 2 D02R573, Ireland (hereinafter: GoTo). We have concluded a data processing agreement with GoTo. In this agreement, GoTo agrees to comply with the applicable data protection regulations.
Your webinar data will be deleted automatically at the end of the webinar. We store the data for advertising purposes until you revoke your consent.
GoTo will process and store your data on servers in the United States, among other places (for more about data transfers to the United States, see also Pt. 5).

f) Participation in prize draws, contests or similar promotions
From time to time, we offer the opportunity to take part in prize draws, competitions or similar promotions. To carry out these promotions, personal data such as email address, name, address and possibly other information necessary for the promotion may be collected and processed. All personal data provided for such a promotion will only be used to carry out the promotion, e.g. for the notification or delivery of the prize. The data will be deleted after the end of the promotion, provided that there are no retention obligations. The legal basis for the processing of the promotion is Art. 6 para. 1 lit. b GDPR.
g) In the context of business contact
For the initiation or conduct of a business relationship, we will process in particular your contact data (name, address, telephone number and e-mail address).
The legal basis for this processing of your personal data is Art. 6 para. 1 lit. a) and lit. b) GDPR (your consent or pre-contractual measures, contract performance), provided that we receive the data directly from you or we enter into a direct contractual relationship with you. Your consent also forms the legal basis for data processing if you have agreed to be contacted in the context of reference requests.
You may withdraw your consent at any time with effect for the future without incurring any costs other than the transmission costs according to the basic rates. The processing of your data until withdrawing remains lawful. You can withdraw your consent by sending an e-mail to datenschutz@elementar.com or by sending a message to the contact details given in the imprint.
If you are not an actual or potential business partner yourself, we have usually received your contact details from our business partner, who has named you as a contact person. In this case, the processing of your data is based on Art. 6 para. 1 lit. f) GDPR (legitimate interests).
h) Use of cookies
Our website uses so-called cookies in several places. Cookies are small text files that are sent to your browser by our web server when you visit our website and are stored on your end device for later retrieval. They serve to make our offer more user-friendly, effective and secure.
Overview of used cookies:
The use of technically not necessary cookies will only take place after your consent. The legal basis for this is Art. 6 para. 1 sentence 1 lit. a GDPR. You can withdraw your consent at any time with effect for the future by making the appropriate settings in the cookie banner and/or in the settings of your browser or by deleting the cookies in your browser.
You can delete already set cookies at any time via the settings of your browser or other software programs. Please note that in this case not all functions of our website may be available.In particular, we would like to draw your attention to the following technologies that we use on our website.
(1) Audience measurement with Google Analytics 4 (GA4) and server-side tagging
We use Google Analytics 4 (GA4) from Google Ireland Limited (“Google”) on our website. To protect your data as effectively as possible, we have configured data collection to be privacy-friendly: We use server-side tagging (SST). The data does not flow directly from your device to Google, but is first sent to our own EU server and filtered there.
How your data is processed depends on your decision in our cookie banner:
- With your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG): If you consent, GA4 stores analytics cookies on your device. These enable us to conduct a detailed analysis of your user behavior (e.g., repeat visits, click paths). You can revoke your consent at any time via our cookie settings.
- Without your consent (Art. 6(1)(f) GDPR): If you decline, we strictly respect this technically. No cookies are set, and your device is not tracked (Section 25 TDDDG does not apply). To still obtain basic, purely statistical data about the use of our website, we collect only passive header data (e.g., your truncated IP address, browser type, page accessed). Our legitimate interest lies in the error-free provision and anonymous reach measurement of our website, without identifying you as a person or recognizing you across websites.
Data protection via our server (IP anonymization): All data (with or without consent) is immediately filtered on our EU server. Your IP address is truncated by the last octet before being transmitted to Google. This prevents any direct personal identification before the anonymized statistical data is transmitted to Google’s servers (which may be located in the U.S.). The data is not merged with other data from Google.

(2) Google Ads (Conversion Tracking)
We use the online advertising program Google Ads. To measure the success of our ads, we use conversion tracking. This data traffic is also routed through our own server-side proxy to prevent direct connections to Google.
- With your consent (Art. 6(1)(a) GDPR): Only if you consent will a conversion cookie be stored on your device when you reach us via an ad. This allows us to accurately attribute advertising success.
- Without your consent (Art. 6(1)(f) GDPR): If you decline tracking, no cookies will be set. Only passive server-side signals (pings) are processed. In doing so, we filter out individual click identifiers (such as the Google Click ID) on our server to generate only aggregated, anonymous statistics (e.g., total clicks). No profiling takes place.

(3) Google Analytics Advertising Features
We also use GA4 advertising features to generate reports on performance based on demographic characteristics (age, gender) and interests.
- Strict opt-in (Art. 6(1)(a) GDPR): These features for audience targeting and remarketing are disabled by default. They are only activated if you have expressly given us your consent to do so.
- If you decline: Without your consent, no demographic data is collected. We technically prevent any cross-device identification (e.g., via “Google Signals”) for advertising purposes.
(4) Microsoft Clarity
We use Microsoft Clarity on our website, an analytics service provided by Microsoft Ireland Operations Ltd., One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland (“Microsoft”).
- Use only with consent (Art. 6(1)(a) GDPR): This tool is used strictly only with your express consent, which you can provide via our consent banner. Microsoft Clarity enables us to better understand user behavior on our website (e.g., clicks, scrolling movements, mouse paths) through heatmaps and session recordings, and to optimize our offering technically and in terms of content based on these insights.
- Consequences of refusal: If you refuse to give consent, Microsoft Clarity will not be loaded. In this case, this tool will not collect any data regarding your user behavior. Use based on legitimate interests or via passive data streams is not intended for this tool.
- Data Security and Transfers to Third Countries: The data collected through the use of Microsoft Clarity may be transferred to Microsoft servers in the United States. Microsoft relies on the EU Commission’s Adequacy Decision (EU-US Data Privacy Framework) as well as agreed-upon standard contractual clauses to ensure an adequate level of data protection.

(5) LinkedIn Insight tag
We use the Insight tag of the social network LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA ("LinkedIn") on our website. With this measure, we want to design our website to meet the needs and convenience of our users and continuously optimize its content and technology.
The LinkedIn Insight tag allows for the collection of information about visits to our website, including URL, referrer URL, IP address, device and browser characteristics, timestamps and page views. This data is encrypted, anonymized within seven days, and the anonymized data is deleted within 90 days. LinkedIn does not share any personally identifiable information with us, but only provides aggregated reports about the website's audience and display performance. LinkedIn also provides retargeting for website visitors so that we can use this data to display targeted advertising outside of our website without identifying the LinkedIn member. LinkedIn members can control the use of their personal information for advertising purposes in their LinkedIn account settings.

(6) Social plug-ins
On our website we use the plug-ins of the social networks Twitter and Youtube. We do not use direct plug-ins, but use the so-called Shariff solution. You can decide for yourself if and when data is transferred to the operators of the respective social networks. When you visit our website, no data is automatically transmitted to the social networks. Only when you click on the respective button does your browser establish a connection to the servers of the respective social network.

(7) Google Lead Forms (Google Ads)
We use Google Ads lead forms. With this extension of our Google Ads, we can record your contact requests directly and thus make it easier for interested parties and potential business partners to contact our company.
The following personal data may be collected from you in these forms:
- First and last name
- Work e-mail
- Company name
- Country
Your personal data is stored by Google and made available to us for a period of 30 days for retrieval on the Google servers. At the end of this 30-day period, the data is automatically deleted by Google.
The data obtained in this way will be used by us to process/answer your request and - if necessary - transmitted to our group companies (Section 7).
We process your personal data on the basis of our legitimate interest, Art. 6 para. 1 lit. f) GDPR, which consists in the facilitated and direct contact possibility and, if necessary, also for the implementation of pre-contractual measures, Art. 6 para. 1 lit. b) GDPR.

3. Security
We take all necessary technical and organizational security measures to protect your personal data from loss and misuse. We store your data in a secure operating environment that is only accessible to authorized persons. If you wish to contact us by e-mail, please bear in mind that, due to the nature of the Internet, the confidentiality of the information transmitted can never be 100% guaranteed and the content of e-mails could possibly be viewed by unauthorized third parties.
4. Storage of personal data
After expiry of the intended storage period, withdrawal of any consent granted or successful objection to the processing of your personal data and after expiry of tax and commercial law storage regulations, your personal data will be completely deleted, unless you have expressly consented to any further use of your data or this is otherwise legally permissible or necessary.
5. Transfer of your personal data to third parties
Your personal data will not be passed on or otherwise transferred to third parties unless this is stated in this Privacy Policy and the transfer is necessary to achieve the stated purpose (e.g. to commissioned technical service providers) or you have expressly consented to this.
6. Transfers to third countries
Personal data will only be transferred to a third country or an international organization if we inform you of this and if the requirements in Art. 44 et seqq. GDPR have been fulfilled.
A third country is a state outside the European Economic Area (EEA) where the GDPR cannot be applied directly. A third country is considered unsafe if the EU Commission has not issued an adequacy decision for the country pursuant to Art. 45 (1) GDPR, confirming that the country has established appropriate protection for personal data.
We will transfer your personal data only if the recipient offers adequate guarantees pursuant to Art. 46 GDPR for the protection of personal data, if you have explicitly consented to the transfer pursuant to Art. 49 (1) lt. a) GDPR, if the transfer is necessary to fulfill contractual duties between you and us, or if another exception from Art. 49 GDPR applies.
Guarantees pursuant to Art. 46 GDPR can include standard contractual clauses, for instance. In these standard contractual clauses, the recipient agrees to provide adequate protection for the data that guarantees a level of protection comparable to the GDPR.
7. Group Companies
Personal data is transferred to our following group companies in compliance with the provisions of the GDPR and this privacy policy, in particular in accordance with sections 5 and 6 (e.g. as part of your consent to receive our newsletter). 8. Your rights as a data subject
As a data subject within the meaning of the GDPR, you have the right
- pursuant to Art. 15 GDPR to request information about your personal data processed by us;
- pursuant to Art. 16 GDPR to demand the immediate correction of incorrect or incomplete personal data stored by us;
- pursuant to Art. 17 GDPR to request the deletion of your personal data stored by us;
- pursuant to Art. 18 GDPR to request the restriction of the processing of your personal data;
- pursuant to Art. 20 GDPR to receive your personal data that you have provided us with in a structured, common and machine-readable format or to request that it be transferred to another controller;
- pursuant to Art. 7 para. 3 GDPR to withdraw any consent granted to us at any time. As a result, we may no longer continue processing based on this consent for the future. This does not affect the lawfulness of the processing that was carried out on the basis of the consent until the withdrawal.

Right to object and right to lodge a complaint
In addition, pursuant to Art. 21 GDPR, you have the right to object to the processing of your personal data.
If you object, we will no longer process your personal data, unless we can prove compelling reasons for processing that are worthy of protection and outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims on our part.
In the event of violations of data protection regulations, you as the data subject have the right to lodge a complaint with a competent supervisory authority pursuant to Art. 77 GDPR. The competent supervisory authority is the Data Protection Commissioner of the State of Hesse.
